Withdrawal of Nomination

Withdrawal of Nomination

Migration Tasmania may withdraw a nomination at any time if it finds that false or misleading information was provided in support of the nomination application. This applies to all information and claims submitted as part of the nomination process, including the Registration of Interest (ROI).

Withdrawal of nomination may result in the visa application being refused by the Department of Home Affairs.

Reasons to withdraw nomination

Migration Tasmania may conduct checks after a nomination has been approved. If these checks identify information that suggests the nomination was based on false or misleading claims, the nomination may be withdrawn.

For example, concerns may arise if a nominee leaves their Tasmanian employment and relocates interstate immediately after nomination, as this may indicate that they did not genuinely intend to settle in Tasmania or continue work in their industry of employment as declared in their application.

A nomination may also be withdrawn if evidence emerges that documents or information provided during the application process were fraudulent, even if this was not identified until after the nomination was approved.

Invitation to explain why nomination should not be withdrawn

If Migration Tasmania believes that false or misleading information has been provided and that there are therefore reasons to withdraw nomination Migration Tasmania will email the nominee setting out those reasons and inviting them to explain why nomination should not be withdrawn.

Nominees will normally have seven days to respond to this information. This period can be extended if requested and justified by the nominee.

Nomination withdrawal considerations

After the timeframe has expired or a response has been received, Migration Tasmania will make a decision whether or not to withdraw nomination, considering the following factors:

  • the accuracy and reliability of the adverse information
  • any matters of a compelling or compassionate nature raised by the nominee
  • the accuracy and reliability of information provided by the nominee
  • the potential financial, psychological, emotional or any other hardship that may be caused to the nominee and any family members, particularly if there is any level of doubt regarding the adverse information
  • the potential impact upon the integrity, delivery and reputation of the Tasmanian Skilled Migration State Nomination Program if the nomination is not withdrawn.

Decision whether or not to withdraw nomination

After all information has been considered against these factors, the nominee will be advised of the decision and the reasons. If nomination is withdrawn, Migration Tasmania will immediately advise the Department of Home Affairs.

A decision to withdraw nomination cannot be reviewed.
